Why do I need a notary bond in Oklahoma?

The Oklahoma Secretary of State requires notary publics to post a $1,000 surety bond to protect the general public and the state from a notary public’s mistakes, negligence, or misuse of the notary stamp and signature. If a notary fails to adhere to the terms of the surety bond contract, a claim can be filed against the bond. If the claim is proven in a court of law, the surety will reimburse the harmed parties up to the full bond amount, and the notary will be responsible for reimbursing the surety for damages paid.

How to become a notary public in Oklahoma

Potential notary publics in the state of Oklahoma must meet the following minimum requirements:

  • Be 18 years of age or older
  • Have no felony convictions
  • Maintain proficiency in the English language

Should an applicant meet the above minimum requirements for becoming a notary public, an individual seeking a notary commission must furnish a $25 application including the notary’s name, resident address, current or prior commission, email address, telephone number, and signature.

Upon receipt of commission, notaries must purchase a notary seal and a surety bond. The notary seal must contain the notary’s name, the words “State of Oklahoma,” and “Notary Public.” In addition, the oath of office, loyalty oath, official signature, impression of notary seal, and notary bond must be filed with the Secretary of State within 60 days of an individual’s commission being issued. The filing fee for the applicable documents is $10.

How to become a remote notary in Oklahoma

Effective on January 1, 2020, per Oklahoma Senate Bill 915, notary publics with an active, current commission in the state of Oklahoma are eligible to perform remote online notarizations. Potential online remote notaries must fill out the remote online notarization application. Upon approval to perform remote notarizations, notary publics must keep an electronic journal of all remote notarial acts.

Remote online notaries may charge a maximum fee of $25 for their services. Should a remote online notary not personally know the individual whose documents are being notarized, the notary must verify the identity of the principal through a multifactor identification process that includes credential analysis and identity proofing.
